If you are planning to apply for Permanent Residency, please contact me by all means. You have to be very careful.
If you have lived in Japan under a certain visa, it seems that you are eligible for a permanent residency. However, living for a decade alone is not the only requirement.
More specifically:
- Be of good conduct
Abiding by the law and living their daily lives without being socially criticized as residents.
- Having sufficient assets or skills to support one’s livelihood independently
You do not become a burden on the public in their daily lives, and based on your assets and skills, you are expected to live a stable life in the future.
- The person’s permanent residence is deemed to be in the interests of Japan.
a) In principle, you must have continuously resided in Japan for 10 years or more. However, you must have continuously resided in Japan for 5 years or more with a working status (excluding the statuses of residence “Technical Intern Training” and ” Specified Skilled Worker s No. 1″) or a residence status.
b) You have not been sentenced to a fine or imprisonment, etc. You have duly fulfilled your public obligations (tax payments, public pension and public health insurance premiums, and obligations such as filing notifications as stipulated in the Immigration Control and Refugee Recognition Act).
*As a general rule, the fulfillment of public obligations will be evaluated negatively if they have not been fulfilled within the initial tax payment period, even if the tax has already been paid at the time of application.
c)For the status of residence that you currently hold, you are residing in Japan with the maximum period of stay stipulated in Appendix 2 of the Enforcement Regulations of the Immigration Control and Refugee Recognition Act.
d) There is no risk of it being harmful from a public health perspective.
However, if you are the spouse or child of a Japanese national, permanent resident, or special permanent resident, (1) and (2) above are not required to be met. Furthermore, in the case of persons who have been recognized as refugees, persons recognized as persons eligible for complementary protection, or persons who have been resettled in a third country, (2) above is not required to be met.
(There are some exceptions).
Some applicants get quite confused after applying without knowing the above requirements. Once such a thing happens, there could be a difficulty when you apply for a renewal of your current visa afterwards. Please be careful.
